Idaho barista fends off robber with gun; arrest made

A 17-year-old boy was arrested this morning following an attempted holdup of a coffee stand in Coeur d’Alene in which the barista pulled a gun on the would-be robber.

A plainclothes deputy sheriff for Kootenai County was in the area of the robbery serving civil papers when a radio broadcast went out alerting officers to the incident.

The robber had a gun in the attempt to take money from Sunshine Espresso at Ironwood Drive and Government Way, but left without getting any cash.

The barista, Michelle Cornelson, said the robber showed a handgun and demanded money, but when a vehicle pulled into the lot for an order, it caused the robber to lower his gun, according to Coeur d’Alene police.

She told police she used the distraction to grab her own weapon and point it at the robber, ordering him to leave.

State court: Harold Fish no longer convicted felon

State court: Harold Fish no longer convicted felon
The Arizona Supreme Court lets stand a state appellate court's overturning the second-degree murder conviction of trailside shooter Harold A. Fish.

By LARRY HENDRICKS
Assistant City Editor
Wednesday, December 02, 2009

Harold A. Fish, 62, convicted of second-degree murder in a Coconino County trailside shooting death of Grant Kuenzli, is no longer a convicted felon.

The Arizona Supreme Court Tuesday declined a request by Attorney General Terry Goddard to review the state appellate court's overturning of Fish's conviction. "He's now a free man," said Fish's Flagstaff-based attorney Lee Phillips. "He's no longer convicted of an offense, and justice has prevailed."

Fish was convicted in June 2006 for the May 2004 shooting death of Kuenzli on a National Forest trail in the far southeast corner of the county. He argued at trial that he fired in self-defense after Kuenzli came at him aggressively after firing a warning shot at two dogs in Kuenzli's care.

He hit Kuenzli three times in the chest and two wounds were fatal. Kuenzli did not have a weapon in his hands at the time of the shooting.

The prosecution argued that Fish overreacted and took a man's life when other, less lethal options were available. A forensic report suggested that Kuenzli was in a defensive position when he was shot.

In June, the appellate court ruled that the jury was not instructed properly as to what constitutes "unlawful physical force." The court also decided the jury should have heard evidence that Kuenzli was known to act violently when confronted about dogs in his care.

Clerk Who Shot Robber Acted in Self Defense

Clerk Who Shot Robber Acted in Self Defense
Posted: Dec 1, 2009 01:05 AM

By Nicole Garcia

Fresno –The U–Save liquor store on Tulare and Maple Avenues in Fresno was open for business the day after a store clerk turned the table on an armed robber.

Police say 29–year–old Fernando Valencia and another man tried to rob the clerk at gunpoint Sunday night.

Valencia had a semi–automatic gun, and so did the store clerk.

"He had pointed the firearm at the business owner, at some point in time the business owner became fearful, when he found an opportunity to shoot the suspect, he did," said Fresno Police Chief Jerry Dyer.

Valencia died inside the store.

Valencia has a criminal history, which includes car–jacking, carrying a concealed weapon, and stealing vehicles.

The deadly confrontation was all caught on surveillance video.

The police chief says the killing looks to be an act of self defense.

"It's too bad... Whatever the clerk did, I think he did a good job," said Mark Singh, a liquor store manager.

Singh says businesses in that area, are prone to armed robberies, which is why he makes a weapon available for his overnight cashiers.

"Everyone who works behind the cash register, they have access to the gun," said Singh.

And the police chief fully supports business owners' rights to arm themselves for protection.

"In this incident, where the store owner made the decision to arm himself and shoot someone, as tragic as it is, that business owner had the right to defend himself in his own business and defend his property," said Chief Dyer.

Chief Dyer says there has been a spike in business robberies recently in Fresno.
